Access to Information Act


Introduction

Every Jamaican citizen has a right to participate in the decision making process of his country; each has the right to seek and receive information related to operations in the government. The Access to Information Act is an avenue to exercise that right; it is a powerful tool, which all Jamaicans can use to effect change. Access to Information serves to hold government accountable for decisions made and to help uncover corruption and inefficiencies in government.

Jamaicans for Justice and the Access to Information Act

Jamaicans for Justice has had a major impact on a number of areas, which affect citizen’s rights in the society.

The organization was among groups that lobbied in Parliament for the passage of the Access to Information Act (ATI), which was passed in July 2002.

Jamaicans for Justice has conducted a number of public education and media campaigns on the importance of access to information and the use of the Access to Information Act. In this regard the official launch of the ATI Help Desk was held on June 13, 2005. The Help Desk is situated at the offices of the Jamaicans for Justice, I Grants Pen Road, Kingston 8. Telephone numbers (876) 755-4524-6, and will assist persons in making a request for information and in monitoring such request on the specially designed database.

What exactly is the ‘Access to Information Act?

The Access to Information Act was passed in parliament in July 2002 and came into effect in January 2004 on a phased basis. All Ministries, Agencies and Government bodies came under the Act as of July5, 2005. The Act gives citizens a general right to access documents held by public authorities including government agencies and organizations partly owned (at least 50% shares) by government.

Why is the Act important?

In any country, it is important that citizens are given the right to express ideas and concerns and to have a say in the decision making process of that country. The Act is useful in revealing inefficiency in government and in clarifying issues that concern you. I t will be crucial in effecting policy change and improved governance

What type of information can I access?

You can ask for government related documents. It includes all types of information including copies of documents, computerised records, emails, maps, audio- visuals etc. You may ask to view or listen to the document.

How do I access the information?

Before making a request, try as much as possible to identify the document you need information on. If this is not possible, then go ahead and send in your request just the same. The receiving Ministry/ Agency will forward it to the correct Ministry/ Agency.

Who can access the information?

The service is available to everybody!! Even foreigners have access.

How long does it take for me to get the information?

Your request should be addressed no later than 30 days after the application is received. If there is difficulty finding the information the authority will inform you. If the request ends up at the wrong authority it will be transferred to the relevant authority within fourteen days. If after the allotted time passes and you receive no reply, you can ask for an Internal Review.
